described as an embarrassing setback for the obama administration as a federal appeals court panel unanimously ruled that president obama violated the constitution. welcome to "america live" everyone, i'm megyn kelly, we have been talking about this story for a while and now we have a ruling. it all stems from a fierce election-year showdown between the president and congressional republicans when president obama bypassed them with a series of recess appointments. it included -- it involved, i should say, three vacancies on the national labor relations board. that's the board that adjudicate disputes between the companies and the union. when a pro democratic, tend to stack it with pro labor guys and the president gets to do that. however, they require senate approval and president obama couldn't get senate approval for the guys he wanted to put on the nlrb. what did he do? he waited until he believed the senate was in recess and then he stacked the board. well, the senate came back and said, we weren't in recess and fine to do recess appointments, but we weren't in recess and you v

immediately. the terror threat in north africa is a growing concern for the obama administration. one that is opening up an incredibly divisive debate about what the united states should do. pentagon correspondent chris lawrence is "outfront." hillary clinton says it's risky to ignore this rising threat. >> benghazi did not happen in a vacuum. instability in mali has created an expanding safe haven for terrorists. >> reporter: and the defense secretary sounds like a man ready to go on offense. >> we've got to go after al qaeda, wherever the hell they're at. and yes, in mali if necessary. >> reporter: but the white house is not embracing the same tough talk. >> we are working with france and support their effort in mali, and believe that the goal of preventing terrorists' safe haven is an important one. >> reporter: in public, the administration swings from forceful to tentative. a senior u.s. official said the defense secretary's tough talk is classic panetta. -style push to get those stiff gun measures passed, that you just talked about. the obama administration has sort of taken this tactic in the past, during the payroll tax cut fight, during the student loan fight, really circumventing congress and trying to build a ground swell of support among the people, to pressure congress to get what it wants to get done passed. so in this case, that is the stiffer gun law. so you're going to see vice president biden out today, holding that roundtable, talking about gun legislation. he'll be joined by his cabinet secretaries as well as a democratic senator, tim kaine, to really try to talk to the people about why he thinks this for gun legislation is a good idea. but, of course, as you just mapped out, there is a lot of opposition to this, particularly in states like virginia. so they're hoping to get moderates on their side, so that when this really does go to a fight, they will have the votes in the end. senior administration officials tell me, privately, they think that there is a lot of support for universal background checks and for limiting high-ca

on the latest step in the obama administration's effort to pass new gun control legislation. >>> reporter: vice president joe biden is heading to virginia today to try to gain public support for president obama's gun control proposals. >> it's not about keeping bad guns out of the hands of good people. it's about keeping all guns out of the hands of bad people. >> reporter: on capitol hill thursday gun victims and law enforcement officers joined a group of democratic lawmakers as dianne feinstein announced her own bill which would eliminate high capacity magazines and ban assault weapons. >> military-style assault weapons have but one purpose, and in my view that's a military purpose. >> reporter: the lawmakers say the shooting at sandy hook elementary school shows that assault weapons need to be banned. >> a number of the police who came to newtown said to me, we could not have stopped that shooter even with the body armor we were wearing with that kind of assault weapon. >> reporter: but vice president biden downplayed the need for an assault weapons

supports that. and that is the centerpiece of what the obama administration is proposing for guns, for gun reform, background checks for everybody, 91% support. and that is that number that is consistent across polls. the big "new york times" national poll on this last month had it at 92%, not 91%. so you can split those hairs if you want. but basically, it's kind of unanimous. the "washington post" did roughly the same polling. again, a national poll on these policies. but when the "washington post" did it, they broke it down by party, which ends up being really useful. look at the support for the stuff from republicans specifically. the only one that flips, that drops below majority support, the only one where republicans do not give it majority support even though the country as a whole does, is specifically the idea of banning assault rifles again. but still, that one's close. even among republicans, 45% of republicans think we ought to be banning assault weapons again. that's the only one that flips. all the rest of them still majority support even from republicans. banning high-capac
